A casual labourer is still nursing injuries to his head and hip bone after a liquor vendor allegedly smashed his head with a pan, accusing him of contemptuously refusing to have a bite of a birthday cake she had served him, along with some mouth-watering dishes.
Evans Kidero Okoth has now moved to court to sue Mary Angara Oponyo, a businesswoman who sells liquor in Kayole Estate.
Angara is alleged to have attacked Kidero on February 8, while at her place of work.
It is reported that Angara was celebrating her birthday and decided to treat her clients with extra cake and food.
The complainant was seated on a bench, enjoying his favourite drink when Angara began cutting the cake and distributing it among clients. The complainant refused the cake, stating that he was fine with just his drinks, a gesture that seemed to offend the accused.
Shortly afterward, the accused began serving food she had cooked, and the complainant again, declined to take it. Out of anger, the accused confronted him claiming he would not leave until he paid Sh800, which she claimed he owed her.
The complainant, however, boldly told her that he would not pay for something he had not consumed. She instructed two other clients not to let the complainant leave, accusing him of being too proud yet he owed her money.
When it was time for the complainant to leave, he was restrained and wrestled to the ground before the accused grabbed a pan and smashed it over his head, sending him to the floor.
Angara’s accomplices went berserk, picking up stones and throwing them at him. He sustained serious injuries and lost consciousness. He was rushed to Mama Lucy Kibaki Hospital for first aid before being referred to Kenyatta National Hospital, where he underwent intensive tests and treatment.
Angara, who appeared before Makadara Chief Magistrate Kennedy Bidali, denied the claims. The court granted her a cash bail of Sh10,000 after she stated, through her counsel, that she had a sickly child left unattended at home. The matter is scheduled for mention on March 9.
