A man has admitted to stealing items valued at Sh4,500 from his landlady to get money to assist his wife, who was admitted to hospital after delivery.

Johnstone Amboso, appeared before Kakamega Resident Magistrate Carolyne Cheruiyot charged with stealing a DVD player, a panga, a jembe and bedsheets belonging to his landlady, Jane Mwendwa.

“Yes, I took those items,” he said, supplementing his statement during mitigation with a plea for leniency. “I ask for understanding, I am a first time offender. My actions were driven by necessity. My wife was in hospital with our baby, and I lacked means to provide for them.”

She ordered the prosecution to prepare a pre-sentence report and ordered the exhibits returned to the complainant prior to sentencing.

“Ensure the report is ready by May 30th, 2024 to assist the court in determining the appropriate sentence,” she instructed.

According to the prosecution, the accused visited the complainant’s house on May 13, 2024, to collect his belongings after the landlady ordered him to vacate after a disagreement.

Despite this, the accused entered the house and stole the items.

The landlady confronted him, but he threatened her with violence. She reported the incident to the area Assistant Chief and at Ejinja Corner Police Station.

Upon receiving information about someone attempting to sell suspected stolen items, the assistant chief intervened, and called the complainant who positively identified the accused.
